General Terms and Conditions of Sale and Delivery of Armis Auctions Sàrl
Introduction
These General Terms and Conditions of Sale (hereinafter “GTC”) of Armis Auctions Sàrl (hereinafter “Armis Auctions”) apply to all products and services (hereinafter “Products”) offered by Armis Auctions. Any individual or legal entity (private person or company) maintaining a business relationship with or connected to Armis Auctions is considered a customer.
1. Scope
The GTC apply to all Products, whether paid or free of charge, offered by Armis Auctions. All sales or deliveries are made exclusively under these GTC. Any conflicting customer general terms are only accepted if expressly approved in writing by Armis Auctions.
A contract is deemed concluded as soon as the customer confirms acceptance of the GTC, notably by clicking an acceptance button. The current version of the GTC is available online on the Armis Auctions website. A printed version may be requested.
2. Weapons Law
Armis Auctions operates exclusively under applicable Swiss law, particularly—but not exclusively—the Swiss Federal Act on Weapons. Any illegal or dubious transactions are expressly rejected. Suspicious requests will remain unanswered. Armis Auctions also reserves the right to exclude any person from its services or access to Products without justification.
3. Services
Armis Auctions commits to providing its services professionally and carefully, in accordance with these GTC and applicable contractual provisions. In case of contradiction, the specific terms of the contract or offer take precedence over the GTC. Armis Auctions strives to offer the most interesting and highest quality Products at all times.
4. Offer and Prices
All offers by Armis Auctions are non-binding. Current prices are published on the online store. Subject to errors or changes, Armis Auctions reserves the right to make special agreements with customers.
Prices are binding at the time of order. In exceptional cases, Armis Auctions may adjust prices retroactively, informing the customer, who may then cancel the order.
Unless otherwise stated, prices include VAT, any advance recycling fees (ARF), and copyright levies for customers in Switzerland. For international deliveries, a prior agreement is required.
5. Payment Terms
Unless otherwise agreed, payment must be made in advance by bank transfer or in cash upon collection. Long-standing regular customers may be granted payment by invoice, at Armis Auctions’ sole discretion, without obligation to justify.
Invoices must be paid within ten (10) days. No discounts are granted. In case of delay, standard default interest will be charged. Armis Auctions reserves the right to cancel all or part of the order and charge associated costs if payment conditions are not met.
In case of deteriorated creditworthiness, Armis Auctions may request additional guarantees, even after partial delivery of Products.
6. Payment Default
In case of non-payment or delayed payment, Armis Auctions may suspend future services until full advance payment. A registered payment notice will be sent; if payment is not made within eight (8) days, the contract will be automatically terminated without further notice.
7. Delivery
By accepting the order and sending the corresponding confirmation, Armis Auctions commits to delivering as quickly as possible, and the customer agrees to receive the Products. In case of non-delivery, a right of withdrawal applies after four (4) weeks from the agreed date.
Special orders cannot be cancelled once placed. Stated delivery times are indicative and may change without notice.
Out-of-stock Products must be procured from suppliers. The purchase contract depends on the actual availability of the Products. An automatically confirmed order is not a guarantee of availability.
Delivered Products remain the property of Armis Auctions until full payment. Armis Auctions reserves the right to register a retention of title.
In case of cancellation, a fee of 10% of the order value or a minimum of CHF 50.– will be charged.
Transport damage or delivery errors must be reported within five (5) days of receipt.
8. Warranty
A 24-month warranty from the date of delivery is provided unless the manufacturer offers a direct or extended warranty. The warranty is valid provided that:
• the Product has not been handled by third parties,
• it has been used as intended,
• the defect was reported within five (5) days after receipt.
Exclusions include: collectible or used weapons, consumables, misused or confiscated Products.
The Product must be returned in its original (or equivalent) packaging with a damage report.
Handling fees may apply for non-defective or out-of-warranty Products.
The warranty includes repair, replacement, or a credit based on the current value. Cash refunds are excluded. The replacement Product warranty does not extend the original warranty. The warranty rights expire one year from the invoice date.
9. Exchanges and Returns
Returns are only accepted with prior agreement. The applicable price is the one valid on the day of return. Special or custom orders cannot be returned or exchanged.
Processing fees of CHF 25.– (CHF 70.– for weapons) apply in all cases.
10. Liability
Armis Auctions undertakes to provide its services carefully and in accordance with these GTC. Any liability for direct or indirect damages, including those due to non-performance, negligence, or improper execution, is excluded, as is the liability of its assistants.
11. Amendments to the GTC
Armis Auctions reserves the right to modify the GTC at any time. Changes are published on the website and take effect upon publication.
The GTC in effect at the time of order confirmation remain applicable to previous orders.
12. Jurisdiction and Applicable Law
Subject to mandatory provisions, the place of jurisdiction is Sion (Switzerland). The contract is governed by Swiss law.Savièse, mai 2025
